Job description
Key Responsibilities
Contracts and Legal Instruments
- Draft, review and oversee execution of contractual agreements and other legal instruments.
- Account for all company contracts and maintain an accurate register and library of legal documents.
- Communicate and track contractual obligations with relevant stakeholders to ensure compliance, mitigate breach risk and escalate required actions.
- Monitor contractual and statutory obligations, including deadlines, renewals and compliance requirements.
- Coordinate execution, stamping, registration, renewal and secure custody of agreements and other legal instruments, where applicable.
Litigation and External Counsel
- Act as the principal internal coordinator for matters referred to external counsel.
- Prepare initial instructions, factual chronologies, supporting documentation and briefs for external counsel.
- Follow up on case status and legal proceedings with the Company’s legal panel and ensure cyclic and ad-hoc reporting to the Chief Human Resources Officer.
- Maintain a litigation and disputes register showing case status, upcoming court dates, rulings, orders, deadlines, external counsel responsible, potential exposure and required management action.
- Monitor the performance of external counsel and external legal expenditure against approved instructions and budgets in coordination with Finance.
Compliance, Risk and Reporting
- Notify the Chief Human Resources Officer and follow up on all contractual breaches and required remedies.
- Ensure significant developments, rulings, deadlines and required actions are promptly escalated to management.
- Prepare a monthly Legal and Compliance Report for the Chief Human Resources Officer covering contracts requiring action, litigation developments, compliance exceptions, upcoming deadlines and significant legal risks.
- Support management on legal and insurance risk identification, compliance and mitigation strategies.
Policy, Advisory and Regulatory Support
- Prepare legal opinions and provide sound legal advice to the Company, with recommendations to management as necessary.
- Assist in the formulation, implementation and amendment of Company policies.
- Monitor, review and recommend modifications to hospitality sector regulations or related laws affecting the Company’s operations for presentation to KAHC, FKE and other associations.
- Coordinate and consolidate documentation and briefs required for internal use and by external counsel.
Qualifications
- Bachelor of Laws (LLB) from a recognized university.
- Post Graduate Diploma in Law from the Kenya School of Law.
- Advocate of the High Court of Kenya.
Experience
- Minimum of 4 years’ experience in reputable legal practice, with a bias towards commercial litigation.
- Relevant experience in employment and commercial law, including litigation exposure.
Technical Competencies
- Technical understanding of the Company’s business, operations and legal structure.
- Outstanding analytical and drafting skills.
- Strong computer literacy.
